New Delhi. A judgement which declared Smt. Indira Gandhi’s election from Rae Bareilly Constituency “null and void” and also barred her from holding constitutional office for six years; was mysteriously missing from all the search engines. Be it the Legal practitioners, students or the general researchers interested in the historic decision, got tired searching the copy. But the good news is that, the Delhi based law firm “Atharva Legal LLP” has finally managed to provide a copy of the missing verdict passed by the Allahabad High Court’s Justice Jag Mohan Lal Sinha. This verdict led to the eventual imposition of Emergency; which is also remebered as the black chapter of Indian Democracy.
45 years ago , Smt. Indira Gandhi on 25th June imposed state of Internal Emergency using Art. 352. Nearly 1,11,000 people were arrested under detention laws, almost 7000 media personnels were put behind bars, and around 22 custodial deaths were reported. The arbitrary and forceful supression of fundamental rights were at its peak. It can be rightfully said that she was “scorned” because of the judgement delivered by Hon’ble Justice Jagmohan Lal Sinha of Allahabad High Court on 12/06/1975 which declared her election void for indulging in #corruption vide S. 123(7) of the RP Act.
